B.C. judge dismisses province’s lawsuit against Canfor

July 12, 2016 – A B.C. Supreme Court judge has dismissed a $5.5 million lawsuit against Canadian Forest Products and its subcontractor, Barlow Lake Logging.

The province accused both companies of negligence in a 2010 forest fire that burned 6,100 hectares of Crown lands near Vanderhoof. The lawsuit claimed the fire was likely caused by sawdust or other flammable material that smouldered near the exhaust components of a feller buncher before falling to the forest floor and igniting.

Canfor and Barlow countered it was equally likely the fire was sparked by lightning.

The judge ruled that, “while Canfor and Barlow may have been in breach of the regulation for failure to post a fire watcher,” a fire watcher could not have “eliminated or significantly reduced the damages to the government.”
